Facts:
1. Euphoria was sailing upwind, on STB and CapMax on port on converging courses 1 1/2 boat lengths apart.
2. CapMax started luffing and contact occured between the top of his mast and the top of Euphoria's mast.
3. No boat took any penalty.

Conclusions:
CapMax on port failed to keep clear from Euphoria on starboard and broke RRS 10.

Decision:
CapMax is DSQ in Race 2
