Facts:
JohnPap on starbord holding his course.
NoMercy on port trying to cross in front, holding his course.
JohnPap bears away at the last moment, to not hit NoMercy 1/4 boat length from her stern.

Conclusion:
NoMercy failed to keep clear and broke RRS 10.
